EiKO Manufacturer's Warranty - Provisions

With this document EiKO-Europe GmbH specifies the conditions for the manufacturer's warranty of its products. It is guaranteed that the products are free from defects, manufacturing and material faults when used as intended.

The warranty period valid at the time of purchase applies. This can be found in the product data sheets, the price list and the delivery documents (delivery note/invoice). Products without a warranty period are not covered by the manufacturer's warranty. The warranty begins on the date of delivery of the product. A warranty claim exists exclusively if the customer has fulfilled his payment obligations.

To assert a warranty claim, the defect must be reported in writing to service@eiko-europe.de immediately after becoming known - at the latest after 10 days. As proof of warranty eligibility, the customer must send in the delivery/purchase receipt as well as a detailed description of the defect and, if necessary, photos/video. More detailed information on the location, temperatures, local conditions, operating hours, etc. must be provided if requested. For items with serial numbers, proof of this number must be submitted by means of photo documentation. Missing information may lead to rejection of a warranty claim.

Whether the defect is remedied by new delivery, repair or credit note is at the discretion of EiKO-Europe. The replacement product may differ in dimensions and design from the original product. All replacement products or parts may contain new or recycled materials. The functionality of all replacement products or parts shall be at least equivalent to that of the product being replaced.

An advance warranty delivery does not constitute an acknowledgement of the warranty claim. EiKO-Europe will make the claim only after appropriate inspection of the defective product. Failure to return the defective product within the 30-day period will automatically result in the rejection of the warranty claim. The delivered replacement will be invoiced including the cost of shipping. This also applies in case of rejection of the warranty claim after inspection of the defective product. Costs incurred and, if applicable, return shipping costs will be charged to the customer.

The warranty services do not include any costs incurred in connection with the rectification of defects (warranty fulfillment), such as installation and removal, transport costs of the defective and repaired or new product, disposal, travel time, lifting equipment, scaffolding and on-site inspection costs. These costs shall be borne by the purchaser.

The fulfillment of the warranty claim does not result in an extension of the warranty period.

The warranty is valid exclusively under the condition that

- the products have been professionally installed and put into operation in accordance with the installation or operating instructions;
- the products are used in accordance with the given product and application specifications (in particular in accordance with the data sheet, product brochure, product label, etc.);
- the permissible limit values for temperatures and voltages specified according to the relevant technical standards or product-specific are not exceeded;

No warranty is granted for/on

- Plastic parts e.g. polycarbonate, as far as they discolor or become brittle due to the natural aging process;
- wearing parts, accessories, filament lamps
- Luminous flux decrease < product specific specified L-value and deviations of luminous flux and power within tolerance +/- 10%;
- Color tolerance LED modules +/- 10%; also for subsequent deliveries due to use-related changes or technical progress.
- Product defects caused by software errors, bugs, Trojans, viruses or similar;
- settings or parameterizations on equipment that change due to wear, fatigue or contamination;
- services required from time to time, such as recommissioning, software updates, etc.
- Force majeure events such as natural disasters, earthquakes, lightning, extreme weather conditions, sabotage, vandalism, power supply interruptions or failures;
- Conditions of the power supply including voltage spikes, over/under voltages that are outside the specified limits of the product.
- Use of the products in corrosive environments (salt, ammonia, oily air, etc.).
- Excessive stress and wear, negligence, neglect, accident, misuse, inappropriate or abnormal use of the product;

The warranty expires immediately if modifications, repairs, service work or troubleshooting are carried out on the products by the customer or third parties without the prior written consent of EiKO-Europe.

The customer's statutory warranty rights are not excluded, limited or modified by these warranty terms.

EiKO-Europe may change these warranty terms at any time. The changes will then apply to all warranties granted from the effective date of the change in question.

When providing warranty services, we are liable, regardless of the legal reason, exclusively in accordance with our General Terms and Conditions of Sale and Delivery in the version current at the time the warranty is granted, which are available for download at www.eiko-europe.de or can be requested from us by the customer. In all other respects, any liability for damages is excluded.

This warranty is subject to German law, excluding the provisions of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising from this guarantee is Landau in der Pfalz, Germany. (HRB 21809 - Local Court Landau i.d. Pfalz)
